ECHR decision in the case of Drozd v. Poland

– This is yet another important judgment showing that the European Court of Human Rights strengthens procedural protections for citizens taking part in demonstrations regarding the independence of the judiciary and reforms often opposed by the public. I consider the case to be a precedent-setting one, important for political rights in Poland, including the right to manifest one’s views, especially in the context of the ongoing public debate in our country. Recall that the Court communicated the case relatively quickly. It shows the validity of the allegations raised in the complaint – says adv. Małgorzata Mączka-Pacholak.

The Court held that Poland was to pay the applicants jointly EUR 1,000 in respect of non-pecuniary damage and EUR 2,361 in respect of costs and expenses.

Background

In the summer of 2017, a series of protests against planned reforms of the judiciary took place in Poland. On 22 June 2017, the applicants participated in a peaceful demonstration against the reforms outside the grounds of the Sejm. They were granted entry passes to the Sejm to observe the parliamentary debate. As soon as they had gone through the entrance gate into the grounds, they unfurled a banner carrying the slogan “Defend Independent Courts” (Brońcie niezależnych sadów). They were immediately escorted out of the grounds and their entry passes were taken off them. The Head of the Parliamentary Service subsequently banned them from entering the premises for a year. Their appeals against the ban, which they alleged limited their right to have access to public information, were rejected because the Head of Parliament Security was not an administrative authority, and his decisions could not be challenged before the administrative courts.

Relying on Article 10 (freedom of expression) and Article 11 (freedom of assembly and association), the applicants complained that the ban on their entering the Sejm had infringed their Convention rights. They argued that the decision of the Head of Parliament Security had had no proper legal basis and lacked precision and clarity on when and for how long somebody’s right to enter the grounds and buildings of the Sejm could be restricted. They contended that the sanction was disproportionate and had been imposed arbitrarily and without a way of challenging it effectively before a court

The application was lodged with the European Court of Human Rights on 9 March 2019.

Let's settle war crimes in Ukraine! Lawyers fight for justice

Project Sunflowers is intended to complement the activities of national authorities and international tribunals established to prosecute and adjudicate international crimes. The main objective of the Project is to collect information on victims of crimes committed in Ukraine as of 24 February 2022 and information on evidence of these crimes.

– More than 14 million Ukrainians have left their homeland to seek shelter in other countries. Many of them have witnessed some of the cruellest crimes imaginable in the modern world, and the scale of their suffering is striking. The number of people harmed by these crimes and potential witnesses is enormous, the collection page says.

Only a few witnesses and victims will testify before investigators and even fewer will testify before the courts. However, it is important to collect as much information as possible about the evidence of these crimes and their victims. Ultimately, it is intended to create a database that can be used by law enforcement authorities, including international ones.

The creation of a database involves the storage of information. Special software is needed to ensure that it is securely transmitted and stored. The costs of the Project are enormous, especially as a network of volunteers is currently being built up in the countries where the refugees are staying.

ECHR decision in the case of Żurek v. Poland

–   This is yet another important judgment of the ECHR critisising changes in the judiciary implemented in recent years. This time, the ECHR also examined allegations concerning the right to the protection of statements made by judge Żurek, who spoke out in a public debate and criticized changes threatening the independence of the judiciary. The ECtHR found that the actions taken against Waldemar Żurek had a “chilling effect” and were intended to deter not only the appellant, but also other members of the judiciary. It is extremely important that the ECHR noted also that the general right to freedom of expression of judges to address matters concerning the functioning of the justice system may be transformed into a corresponding duty to speak out in defence of the rule of law and judicial independence when those fundamental values come under threat  –  says adv.  –  The judgment of the European Court of Human Rights essentially confirmed not only the fact that the rights and freedoms of judge Waldemar Żurek were violated by the instrumental and illegal removal from the National Council of the Judiciary, but also showed how illegal were the actions taken by political authorities who carried out a purge in the NCJ, at the beginning of 2018. This is another judgment confirming the reprehensibility of the so-called justice reform in recent years –  explains adv. Mikołaj Pietrzak.

Judge Waldemar Żurek lodged his application to the ECHR in 2018. Relying on Article 6 § 1 (right of access to court) and Article 13 (right to an effective remedy) of the European Convention on Human Rights, judge Żurek alleged that he was denied access to a tribunal and that there was no procedure, judicial or otherwise, to contest the premature termination of his mandate. Also relying on Article 10 (freedom of expression), he alleged that his dismissal as spokesperson for the regional court and the NCJ, combined with the authorities’ decisions to inspect his and his wife’s financial declarations and tax returns in 2017, were intended to punish him for expressing criticism of the Government’s legislative changes and warn other judges from doing the same.

Following the same reasoning as in the recent Grand Chamber case Grzęda v. Poland (no. 43572/18), the Court found that the lack of judicial review of the decision to remove judge Żurek from the NCJ had breached his right of access to a court. The Court also found that the accumulation of measures taken against Waldemar Żurek – including his dismissal as spokesperson of a regional court, the audit of his financial declarations and the inspection of his judicial work – had been aimed at intimidating him because of the views that he had expressed in defence of the rule of law and judicial independence. In finding these violations, the Court emphasised the overall context of successive judicial reforms, which had resulted in the weakening of judicial independence and what has widely been described as the rule-of-law crisis in Poland.

The Court held that Poland was to pay the applicant 15,000 euros in respect of non-pecuniary damage and EUR 10,000 in respect of costs and expenses.

Background 

Waldemar Żurek, judge with years of experience, was a member of the NCJ, first elected in 2010 and then re-elected in 2014 for a second four-year term of office. In 2014 he was appointed the NCJ’s spokesperson, and, as such, became one of the main critics of the changes to the judiciary initiated by the legislative and executive branches of the new Government which had come to power in 2015. He pointed in particular to the threat to judicial independence stemming from the Government’s proposals. His mandate as a member of the NCJ was, however, prematurely ended in 2018, following the entry into force of new legislation in the context of wide-scale reform to the judiciary. In particular, the Act Amending the Act on the NCJ of 2017 provided that judicial members of the NCJ would no longer be elected by judges but by the Sejm (the lower house of the Parliament), and that the newly elected members would immediately replace those elected under the previous legislation. Thus, when the Sejm elected 15 judges as new members of the NCJ on 6 March 2018, the applicant’s mandate was terminated. He did not receive any official notification. In consequence, he also ceased to act as the NCJ’s spokesperson. Earlier in 2018 the applicant had also been removed from his position as Cracow Regional Court’s spokesperson.

The bill amending the legislation on the NCJ was criticised at national and international level. The adoption by Parliament of this bill, together with bills on the Supreme Court and on the ordinary courts, sparked large public protests in July 2017. Several national bodies issued opinions stating that the amendments violated the Constitution because they allowed the legislature to gain control over the NCJ, contrary to the principle of the separation of powers.

Rola obrońcy w niemieckim procesie karnym - wykład otwarty prof. Piotra Girdwoynia

Interwencja wobec fotoreporterów pod Michałowem. Pełnomocnicy dziennikarzy złożyli zażalenia na zatrzymanie i przeszukanie

Do zdarzenia doszło 16 listopada 2021 r. Fotoreporterzy zostali zatrzymani w trakcie wykonywania obowiązków służbowych w Wiejkach, pomimo tego, że żołnierze od pierwszego kontaktu z fotoreporterami mieli świadomość, że osoby te wykonują swoje obowiązki zawodowe jako dziennikarze. Przed zatrzymaniem, żołnierze byli informowani, że celem dziennikarzy było wykonanie zdjęć dokumentujących obecność Wojska Polskiego na wschodzie Polski (do czego byli uprawnieni).  

Żołnierze zatrzymali dziennikarzy bez podstawy prawnej, działając w sposób rażąco nieprawidłowy, stosując środki przymusu bezpośredniego wbrew zasadzie proporcjonalności i adekwatności. Sposób zatrzymania dziennikarzy świadczył o dążeniu przez żołnierzy do zastraszenia zatrzymanych dziennikarzy oraz wywołania tzw. efektu mrożącego zniechęcającego do relacjonowania wydarzeń ze wschodu Polski.  

W trakcie zatrzymania doszło do przeszukania przedmiotów należących do dziennikarzy. Funkcjonariusze podjęli te działania pomimo tego, że kilkukrotnie byli informowani o tym, że były one objęte tajemnicą dziennikarską.  

W dniu 23 listopada 2021 r. pełnomocnicy wnieśli zażalenia na zatrzymanie oraz przeszukanie dziennikarzy. Skarżący domagają się stwierdzenia przez Sąd Rejonowy w Białymstoku, że ich zatrzymanie było nielegalne, bezzasadne i nieprawidłowe.  

Skarżący stoją na stanowisku, że żołnierze – jako formacja – nie są uprawnieni do zatrzymywania, a okoliczności i przebieg podjętych wobec nich działań wskazują na chęć ich zastraszenia. Ponadto, żądają stwierdzenia, że żołnierze nie tylko nie mieli prawa dokonać przeszukania, ale również, że działania te naruszały tajemnicę dziennikarską. Za szczególnie oburzające należy zaś uznać utrwalanie przez funkcjonariuszy materiałów dziennikarskich, znajdujących się na przeszukiwanych nośnikach. 

W złożonych zażaleniach wskazywano, że czynności podejmowane wobec dziennikarzy przez żołnierzy miały charakter poniżający, zastraszający i uwłaczający. Stanowiły formę represji związaną z wykonywaną pracą dziennikarską.  

Do zażaleń dołączono nagranie, dokumentujące cały przebieg interwencji. Z zapisu rozmów funkcjonariuszy jednoznacznie wynika, że celem ich działania było wywołanie strachu i efektu mrożącego wobec całego środowiska dziennikarskiego.

Zasada nieusuwalności sędziów sądów powszechnych zagrożona? Wnioski z debaty wokół planów spłaszczenia struktury sądownictwa i weryfikacji sędziów

Opracowanie zawierające wnioski z Debaty to reakcja na liczne zapowiedzi przeprowadzenia kolejnego etapu tzw. reformy sądownictwa, tym razem polegającego na spłaszczeniu struktury sądownictwa i weryfikacji wszystkich sędziów sądów powszechnych. Uczestnicy debaty zaprezentowali argumenty wskazujące na poważne niebezpieczeństwa związane z wejściem w życie planowanych zmian ustawowych i ich możliwe skutki. Znawcy prawa konstytucyjnego i europejskiego oraz prawnicy praktycy zwrócili też uwagę na rolę powołanego przepisu konstytucji: stanowi on wyjątek od zasady nieusuwalności sędziów. Jego wykorzystanie powinno być oceniane w kontekście treści całej konstytucji i jej podstawowych zasad. Zaznaczono też, że planowane zmiany spowodowałyby długotrwały chaos i pogłębiłyby obecny kryzys. Rzeczywistym ich celem jest podporządkowanie sędziów i wyeliminowanie niewygodnych osób.

– Sędzia Tuleya stał się symbolem oporu. Bronił praworządności – ale rządy prawa nie obroniły jego. Podjął walkę z systemem i przegrał. Przynajmniej tymczasowo. Ale jest moralnym zwycięzcą. Jest najodważniejszym i najuczciwszym sędzią, jakiego kiedykolwiek spotkałem – wskazał adw. Alexis Anagnostakis, Human Rights Officer, ECBA.

Tęcza nie obraża. Sąd Rejonowy w Częstochowie umorzył postępowanie ws. prezentowania obrazu Matki Boskiej z tęczową aureolą

Klient Kancelarii został oskarżony o to, że prezentując w 2019 roku podczas II Marszu Równości w Częstochowie wizerunek Matki Boskiej z Dzieciątkiem Jezus z tęczową aureolą, obraził uczucia religijne.  

24 września br. Sąd Rejonowy w Częstochowie zdecydował o umorzeniu sprawy, uznając, że zachowanie Klienta Kancelarii nie zawierało znamion czynu zabronionego. Postanowienie nie jest prawomocne, stronom przysługuje na nie zażalenie do Sądu Okręgowego w Częstochowie. 

To nie znieważenie czy profanacja 

W uzasadnieniu postanowienia sędzia podkreśliła, że ikona Matki Boskiej Częstochowskiej stanowi niewątpliwie przedmiot kultu religijnego. Jej zdaniem jednak, ingerencja w ten wizerunek, polegająca na opatrzeniu tęczowymi aureolami obu postaci z ikony stanowiącej przedmiot kultu religijnego, a następnie prezentowanie tak zmienionych wizerunków na marszu nie jest znieważeniem czy profanacją. Sędzia dodała, że mężczyzna „chciał jedynie zwrócić uwagę na ważki problem społeczny jaki stanowi dyskryminacja osób nieheteronormatywnych, w szczególności na ich miejsce w Kościele z definicji powszechnym. Sama zaś tęcza miała w zamyśle oskarżonego odwoływać się do idei równości wszystkich ludzi”. 

– Uzasadnienie, które przedstawił sąd jest dokładnie zbieżne z tą argumentacją, którą przedstawiliśmy w dotychczasowym postępowaniu, także tym prowadzonym przez prokuraturę. Sąd uznał, że nie doszło do popełnienia przestępstwa i przedstawił rzeczowe uzasadnienie – komentuje adw. Małgorzata Mączka-Pacholak. Sąd wydał postanowienie o umorzeniu postępowania na posiedzeniu jeszcze przed rozprawą. Widać, że w ocenie sądu prowadzenie procesu karnego po prostu nie miało podstaw – tłumaczy obrończyni. 

Tło sprawy  

16 czerwca 2019 roku odbył się II Marsz Równości w Częstochowie. Uczestnicy mieli ze sobą tęczowe flagi i elementy odzieży m.in. z reprodukcją obrazu Matki Boskiej Częstochowskiej, na której aureola otaczająca głowy Maryi i Dzieciątka Jezus miała tęczowe barwy. Sprawa wywołała kontrowersje wśród lokalnej społeczności i będących na miejscu kontrmanifestantów. Po doniesieniach osób, które poczuły się urażone zachowaniem uczestników zgromadzenia, sprawa trafiła do Prokuratury Rejonowej Częstochowa-Północ. Status pokrzywdzonych przyznano ok. 40 osobom. 

W październiku 2019 roku śledczy poinformowali, że postępowanie zostało umorzone ze względu na brak znamion czynu zabronionego. Kilka tygodni później sprawa została jednak wznowiona. Uznano, że decyzja o umorzeniu była przedwczesna. Podczas wznowionego postępowania stwierdzono, że wizerunek Matki Bożej z tęczową aureolą niósł oskarżony. Przedstawiono mu zarzut popełnienia przestępstwa obrazy uczuć religijnych innych osób poprzez publiczne znieważenie przedmiotu czci religijnej w postaci obrazu Matki Bożej Częstochowskiej. Mężczyzna nie przyznał się do zarzucanego mu czynu i złożył obszerne wyjaśnienia podkreślając, że jego celem nie była obraza uczuć religijnych, a zwrócenie uwagi na trudną sytuację osób wierzących ze społeczności LGBT.

W postępowanie zaangażowały się organizacje pozarządowe: Kampania Przeciw Homofobii i Helsińska Fundacja Praw Człowieka, które przedstawiły opinie przyjaciela sądu (amicus curiae).

Hearing before the Grand Chamber of the European Court of Human Rights in the case of Grzęda v. Poland

Background

Judge Jan Grzęda lodged his application to the ECHR in 2018. The case concerns a reform of the judiciary in Poland as a result of which the judge’s term of office in the National Council of the Judiciary was terminated halfway through his four-year term.

Relying on Article 6 § 1 (right of access to a court) of the European Convention on Human Rights, Mr. Grzęda argues that he was denied access to a court in order to contest the premature termination of his office. He also complains under Article 13 (right to an effective remedy) of the Convention that there was no procedure, judicial or otherwise, for him to contest the premature termination.

The application was communicated to the Polish Government in July 2019. In February 2021, the ECtHR decided that the complaint, despite the objection of the Polish government, will be examined by the Grand Chamber of the Court.

The Polish Commissioner for Human Rights joined the case and submitted an amicus curiae brief. The following organizations also submitted their interventions: Amnesty International together with the International Commission of Jurists (ICJ), the Helsinki Foundation for Human Rights, the European Networks of Councils for the Judiciary (ENCJ) and the Polish Judges’ Association Iustitia. The UN Special Rapporteur on the Independence of Judges and Lawyers, the Government of Denmark and the Government of Netherlands also presented their positions in the proceedings before the Grand Chamber. All intervenors emphasized the special nature of this case and its importance for the Applicant and other judges-members of the National Council of the Judiciary, whose terms were also shortened in 2018.

Hearing

The Applicant’s representatives drew attention to the circumstances of the premature termination of the term of office of Judge Grzęda and the remaining 14 judges-members of the National Council of the Judiciary and the consequences of this violation, including his inability to appeal against the shortening of his mandate.

During the second part of the hearing, the participants answered questions from Judges of the European Court of Human Rights, concerning i.a. the term of office of judges-members of the National Council of the Judiciary, the jurisprudence of the Constitutional Tribunal and the principles of interpretation under constitutional law, the jurisprudence of the Polish Supreme Court and the Supreme Administrative Court, and the principle of the rule of law.

“The judgment of the Grand Chamber will be of great importance for the functioning of the judiciary in Poland and for the observance of the rule of law,” emphasizes adv. Mikołaj Pietrzak. “Today’s questions from the European Court of Human Rights Judges indicate an in-depth analysis and taking a broad look at the context of the Applicant’s case” – adds adv. “The European Arrest Warrant and in Absentia Convictions"

The symposium was the culmination of the work of researchers from the University of Maastricht and their partners from five member states of the European Union. However, it was also a space to share experiences with judges, prosecutors, lawyers and academics from all over Europe.

Overuse of pre-trial detention in Europe

Fair Trials organised a regional policy meeting in Brussels to help launch a new report, as well as a regional handbook for lawyers, to help ensure effective legal assistance in pre-trial decision-making.

The event brought together more than 60 criminal justice experts from across Europe, including partners from Bulgaria (the Bulgarian Helsinki Committee), Greece (Centre for European Constitutional Law), Hungary (the Hungarian Helsinki Committee), Italy (Antigone), and Romania (APADOR-CH).

Extradition and European Arrest Warrant – a seminar

The seminar covered different subjects related to extradition and European Arrest Warrant, for example basics of EU Law and ECHR Law, bilateral extradition treaties v. The “European Arrest Warrant” system, Comparative extradition law, examples of extradition cases. The seminar was attended by experts from the European Union, USA, Canada, Belarus and Mexico.

In her speech, Ms. Urszula Poznańska provided information on the procedure for issuing and executing the EAW in Poland. She also focused on Poland’s applications for the extradition of citizens to countries outside the European Union, main problems related to the application of the EAW by Polish authorities, as well as the possibilities of defense in cases in which the EAW was issued.

Legal Experts Advisory Panel 2019

The meeting was attended by over 80 experts in the field of criminal law. This annual conference aims to include sharing experiences and discussing challenges in the area of cross-border cooperation in Europe in criminal matters.

The last twelve months has arguably seen a crisis of mutual trust in Europe, with question marks remaining over extradition requests to Poland and what can be done to ensure that defence rights and the rule of law are being respected. The issues around mutual trust was discussed by Gwen Jansen from Gwen Jansen Advocatuur, Andras Kadar from Hungarian Helsinki Committee, and Maria Radziejowska from Pietrzak Sidor & Wspólnicy, facilitated by Fair Trials’ Senior Lawyer Laure Baudrihaye-Gérard.

English-Polish Law Day

In her speech, attorney Katarzyna Dąbrowska focused on extradition and the European Arrest Warrant, as well as on the challenges that may arise in specific cases.

Prof. dr hab. Piotr Girdwoyń

In 2007, Piotr Girdwoyn became the Director of the Forensic Science Centre at the University of Warsaw, where in collaboration with, among others, the Warsaw University of Technology, the National Academic Computer Network and Polish Security Printing Works he has been involved in many scientific projects. In 2016 Prof. Girdwoyn was elected the Director of the Institute of Criminal Law at the University of Warsaw. In 2017 he became a full (tenured) professor of the University of Warsaw. In November 2017 Piotr Girdwoyn was appointed Chair Professor of Criminal Justice College of East China University of Political Science and Law in Shanghai, China (2017-2020), and Visiting Professor of College of Medicine and Forensics, Xi’an Jiaotong University in Xi’an, China (2017-2018).

In 2020 Prof. Girdwoyn was elected as a member of the Senate of the University of Warsaw, member of the Board and member of the Scientific Council of the Polish Forensic Association. On 16th Feb. 2021 Piotr Girdwoyn once again took the role of of Director of Forensic Science Centre at the University of Warsaw. He teaches i.a. Evidence Law, Introduction to Forensic Science, Trial Advocacy, Artificial Intelligence in Criminal Law and Humanitarian Forensics Action (NOHA – Master of Humanitarian Action, University of Warsaw).

Since 2011, he has been a member of the Warsaw Bar Association and since 2018 has been a partner with the Pietrzak Sidor & Partners Law Firm. Piotr Girdwoyn specialises in criminal law, evidence law (particularly with regard to all forensic science questions), medical misconducts, IT-, AI- and other new technologies cases.

He speaks English, German and Russian.

Paulina Szymańska vel Szymanek

Paulina has been working with Pietrzak Sidor & Partners since 2018. Her key areas of expertise are civil and medical law, but she also has experience in handling employment, administrative and criminal cases.

Paulina wrote a number of articles and conference papers on medical and civil law.

Małgorzata Kosucka

She is a co-author of a report on guarantees of protection of freedom of speech and journalistic sources, prepared as part of the works of the Legal Research Group on Protection of Journalistic Sources in cooperation between the ELSA Association and the Council of Europe.

Mikołaj Pietrzak appointed as Chair of the Board of Trustees of the UN Voluntary Fund for Victims of Torture

The UN Secretary-General appointed Mr Pietrzak as one of the five Fund’s Trustees in 2016. The Board of Trustees works closely with the UN High Commissioner for Human Rights and is responsible for developing recommendations on awards of financial assistance for aid actions and projects for victims of torture.

Over 150 states ratified the UN Convention against Torture. Pursuant to the Convention, torture is a crime of international law, the prohibition of torture is absolute and nothing can justify resorting to torture.

Mikołaj Pietrzak is a leading Polish attorney specialising in corporate criminal defence

The ranking includes lawyers from 53 jurisdictions across Europe, including Russia, Ukraine and Turkey, in 25 different areas of law. It presents profiles of lawyers working in arbitration, dispute resolution, corporate law or white-collar crime.

ECtHR to hear the applications of secondary school leavers

In May 2011, a Regional Examination Board (REB) at Ostrowiec Świętokrzyski invalidated the results of the chemistry section of the matura exam taken by a group of students. The decision was based on a contention that they had received improper assistance in completing their exam papers. However, a general note that the students initially received from the Board did not reveal which of the test assignments raised suspicions of exam supervisors.

“The students suffered devastating consequences of the invalidation. Having been deprived of the option to challenge the decision, they could not start the university studies they have been dreaming about and their plans for next several years could no longer be achieved”, argued Paweł Osik, firm’s associate involved in the case.

Proceedings before the Constitutional Court

The students requested a judicial review of the decisions of the Regional Examination Board before an administrative court. However, the court ruled that law did not provide an opportunity for challenging the invalidation of a secondary school leaving exam. Having considered a complaint in cassation against the judgment, Supreme Administrative Court upheld the first-instance court’s decision and emphasised that the possession of a certificate of completion of secondary education did not grant, in itself, a “right” to be admitted to university studies of one’s choice.

Eighteen secondary school students then complained to the Constitutional Court, opposing to the absence of the opportunity to challenge a decision invalidating the matura exam. They argued that this legal loophole violated their right to court and education as well as the right to legal protection of honour and good name.

In 2015, the Constitutional Court held that the absence of the possibility to appeal against the exam’s invalidation to an administrative court was constitutional.

The proceedings before the European Court of Human Rights

In 2015, the students submitted their applications to the European Court of Human Rights. We allege in the applications that a situation where the applicants are unable to challenge REB’s decision, which was crucial for the students at their then-current stage of education, constitutes a violation of the right to a court and a fair trial”, Małgorzata Mączka-Pacholak, an attorney involved in the case. The students also pointed to a violation of the right to education and right to privacy.

The ECtHR’s communication of the case means that it has successfully passed procedural verification and the Government now needs to take a position regarding the points raised in the application. It has not yet been made known when the Court will hear the case.

Lawyers of Abd Al-Rahim Hussayn Muhammad Mr Al-Nashiri submitted representation to the International Criminal Court

On 20 November 2017, Fatou Bensouda, the Prosecutor of the International Criminal Court in the Hague, requested the Court to authorize an investigation into alleged war crimes and crimes against humanity in relation to the armed conflict in the Islamic Republic of Afghanistan since 1 May 2003. This request covers also crimes that are linked to this armed conflict and were committed on the territory of other States Parties to the Rome Statute (the ICC’s founding treaty, to which Poland is a party) since 1 July 2002. According to the Prosecutor, the investigation, if authorized, should concern crimes allegedly committed by the members of Taliban and affiliated armed groups, members of Afghan authorities, as well as members of the US forces and of the CIA. The last category of crimes covers also secret detention and interrogation programme conducted by the CIA in Europe, including on the territory of Poland.

On 6 December 2017, Ahmad Assed, Nancy Hollander and Mikołaj Pietrzak, legal representatives of Mr Al-Nashiri, submitted on his behalf representation under art. 15(3) of the Rome Statute to the International Criminal Court in the Hague to support the Prosecutor’s request. Pursuant to art. 15(3) of the Rome Statute victims of crimes covered by the Prosecutor’s request for authorization of an investigation have the possibility to make representations to the Court. In such representations, victims inform the Court of their views and concerns relating to the possible investigation.

Mr. Al Nashiri is a Saudi national who was subjected to the CIA’s secret detention and interrogation programme intended for so-called “High Value Detainees” – captives from among the Al-Qaeda group suspected of terrorism. This programme consisted of a net of clandestine detention facilities located in Europe, including in Poland and in Romania between 2002-2006, which operated with their authorities’ acquiescence and secret connivance. In these so-called “black-sites” the HVD prisoners – including Mr. Al-Nashiri – were illegally detained and subjected to brutal interrogation techniques amounting to torture and inhumane or degrading treatment, which were developed by the CIA under Enhanced Interrogation Techniques programme.

Earlier in July 2014, the European Court of Human Rights (“ECHR”) held that Poland violated the European Convention of Human Rights and Protocol No. 6 to the Convention by participating in the extraordinary rendition and secret detention of Mr. Al Nashiri in a secret CIA prison on Polish territory and by failing to conduct a “prompt”, “thorough” and “effective” investigation into allegations of serious violations of the Convention, including torture, ill-treatment and undisclosed detention of Mr. Al Nashiri (Al Nashiri v. Poland, ECtHR, Judgement of 24 July 2014).

„The ICC may be the second international court after the ECHR that will adjudicate the case of persons who were detained and tortured by the CIA. Meanwhile, Polish authorities have been investigating the issue of the CIA rendition centers in Poland for almost ten years now, yet ineffectively. Throughout all this time persons who were unlawfully detained and tortured in the CIA rendition centers have had a limited possibility to seek justice.” – says attorney-at-law Mikołaj Pietrzak, who represents Mr. Al Nashiri.

New grounds for claims of Swiss franc borrowers

Banks as managers of customers’ interests

Mr Sidor argues that as far as banks are concerned, the west European legal scholarship treats banks as managers of financial matters of their customers, noting that this approach is increasingly often followed by Polish jurists. “This means that a bank is legally obliged to limit its activities that aim at maximising profits precisely because of the duty of care over a customer’s financial interests. Also, the Polish Supreme Court has developed in its jurisprudence a list of general obligations of a bank towards customers and other persons affected by the bank’s operations. These obligations are a consequence of banks having the status of institutions of public trust. As such, the obligations do not need to originate from specific contractual clauses, bank rules and regulations or provisions of law”, the piece reads.

A bank’s breach of the above general obligations may result in its liability to pay damages to an affected customer. “This was precisely the situation in the case decided by Warsaw’s Regional Court. According to media reports, the conduct of the bank and its appointee, a financial advisor, was extremely dishonest and the information they provided to a customer – “blatantly inaccurate”, Mr Sidor wrote.

ECJ ruling on the duty to properly inform a customer

In the context of the Warsaw court’s judgment, Mr Sidor points to a decision of the Court of Justice of the European Union, in which the Court reviewed Swiss franc-denominated loans given by a Romanian bank. “The CJEU ruled that the absence of proper notification of the foreign exchange risk and related economic consequences (i.e. the risk’s impact on the value of loan repayments) may lead to a significant imbalance of parties’ contractual positions”, the piece reads.

An opportunity for business borrowers

According to Artur Sidor, a bank’s failure to provide sufficient and adequate information on the credit risk, financial advisors’ behaviour that involves inducing purchases of additional, risky products or other disturbing behaviour contravening the principles of public policy can be cited as a cause of action brought by Swiss franc borrowers against banks.

“Importantly, this line of authority may be relied on by businesses taking legal action against banks, in particular by small companies that have no proceeds in Swiss francs. In fact, this is the only ground they may use as remedies against abusive clauses are available for consumers only. Still, in practice, a difference between a business and non-business customer is often illusory and the bank has overwhelming contractual and informational advantage over both”, Mr Sidor concludes in his piece.

Application of the European Arrest Warrant: a meeting of practitioners

The meeting was designed to serve as a platform for sharing experiences of practitioners from across the EU who discussed obstacles and problems related to the application of EAW. The discussion centred on both different aspects of observing the proportionality principle in applying the EAW procedure and grounds for non-execution of the warrant in another Member State.

“Those two elements, the principle of proportionality and the way in which an EAW is enforced in other Member States, are precisely the two aspects of the real-life application of the Warrant that are most commented by practitioners. Despite the continuously rising number of relevant judicial decisions, more and more new issues appear in those two areas, which leads to differences in judicial interpretation between Member States”, Mr Dąbrowska explains.

The discussion also involved topics related to the impact the application of the EAW may have on the protection of fundamental rights, especially insofar as the risk of violating such rights constitutes a ground for a refusal to execute an EAW.
